Objection to the original planning application was made by Bantry Bay Inshore Fishermens Association to aquaculture structures being placed directly above existing active and productive scallop ground. Minister for the Marine Dr. Michael Woods ignored these objections and granted a license. In the face of an appeal by the Irish South and West Fish Producers Organisation and a lengthy and detailed appeal by Bantry Bay Inshore Fishermens Association, the Aquaculture Licenses Appeals Board issued a license to Bantry Bay Mussels for mussel lines at this location.
Work on installation of these lines began on July 11th 2000.
FISH decided to seek a judicial review of the decision by the ALAB.
Through their solicitor, FISH applied to the Minister for the Marine for all documentation relating to the decision. No response was forthcoming and the judicial review deadline passed. A subsequent letter to the Minister for the Marine suggesting that the lack of response had seriously prejudiced the case for FISH, evoked the response that the Minister's office had never received the original request.
FISH are in ongoing consultation with senior politicians and legal counsel.
